Policies & Procedures of the Penguin Group of Companies
 


Organization
This organization is being run in accordance with all rules and regulations as stipulated by the Government of Sri Lanka and in accordance with whatever changes that may occur from time to time.

Recruitment and Probation Period
Employees will be subject to a probation period of three months from the date of recruitment. This will give the employee the opportunity to have an understanding of the company's environment and working condition. During this period if the Management is satisfied with the employee's performance and vice versa, the employee will be confirmed in his/her appointment. However if the Management feels that the employee is not suitable, the Company is free to discontinue the employment.

Prohibition of Child Labour

Under the present labor rules and regulations stipulating the minimum age for recruitment, any person below this age limit will not be recruited for employment.

 
 
 

Every employee should submit an official document whereby the employee's age can be verified to be kept in the personal file.

 
 

Prohibition of Forced Labour

The Company will not resolve to forceful or unlawful means of labour.

Prohibition of Harassment or Abuse
It is the policy of the Company to treat every employee humanely and with dignity and not subject the employee to loss of his/her self respect.

The Company will take whatever steps necessary to see that the employee is not subject to any physical, sexual, mental, or any other form of harassment.

In the event of any of the above named abuses taking place in the establishment, the Company will conduct an impartial inquiry and take appropriate action.

Free movement

The Company respects the free movement of all employees and joint representation at all times. The company's Joint Consultant Committee will at all times look into the aspects of the workers' cordiality, healthy technical atmosphere and any related spheres.

Prohibition of Discrimination
The Company’s most valuable asset is the employee. Therefore whether it be recruitment, payment of wages, benefits, training opportunities, allotment of duties, promotions, discipline, suspension of services - caste, creed, religion, physical attributes, sexual or political affiliations will not be a criteria. The deciding factors will be experience, skill, dedication, loyalty to the company and capability.

Compensation and Benefits

Payment of wages will be in accordance with what is stipulated for the Garment Manufacturing Trade and the minimum wage or norm over and above would be the policy for payment of salaries. Our policy is to pay its workers salaries prevailing in the garment industry either in accordance with the employees' grading or even higher.

Note: The minimum grade to which an employee is initially recruited will be Grade IV.

Within 10 days of the preceding end of month, arrangements will be made for payment of salaries. A pay slip detailing the employee's salary, additional allowances, deductions etc will be handed over to every employee. A Sinhala translation of this pay slip is displayed on the Notice Board.

If there is any error in the pay slip, it should be brought to the attention of the paying officer immediately. This will be brought to the attention of the Administrative Manager and once the problem is sorted out, the relevant payments will be made.

The daily attendance sheet of the employee indicating the time in/time out is displayed on the Notice Board.

At the end of the month prior to computing the salary sheet, the employee will be handed over a copy of this attendance sheet. If there is any discrepancy at that time, it can be brought to the attention of the officer and have it rectified.

Hours of Work/Overtime payment

The Garment Manufacturing Trade Wages Board stipulates wages, the number of hours of work to be put in by an employee per week.

Other than at a time of dire emergency, the number of hours a worker can be requested to work is a maximum of 60 hrs or 57 hrs and within 7 days of work, a day's leave has to be granted. The prime objective of working the basic hours of work is to ensure the physical and mental health of all employees at a high level.

Inclusive of a one hour break, overtime payment is computed after 9 hours.

Note: The Company reserves the right to change the hours of work depending on the exigencies and in accordance with the prevailing rules and regulations.

For the workers information, the tabulation of overtime is displayed on the notice board.

Employees Provident Fund
Every employee will enroll as a member of the Employees Provident Fund and the Employees Trust Fund. In this respect every employee will be given a membership number at the time of recruitment.

The employee will contribute 8% of his/her salary while the Company will contribute 12% of the salary towards the Employees Provident Fund.

The Company will contribute 3% of the employee's salary towards the Employees Trust Fund.

This will be subject to the existing regulations under the prevailing law and will be amended as per directions from the government from time to time.

Health & Safety
The Company undertakes to see to the health and safety of all its employees by providing the necessary accessories, protection gear, working line, advice, training and maintenance work and any related items. When using chemicals, the employees will be advised accordingly. They will also be advised on the use of first aid.

Disciplinary action will be taken against any employee contravening the above instructions.

Environment
The Company is bound to see that the premises and the surrounding area is maintained at a high level and that no action detrimental to the environment will be permitted. Disposal of waste material will be discharged in a manner within the guidelines laid down by the Environment Authority and with no harm to the environment.

Disciplinary action will be taken against any person flouting the above environmental or pollution control regulations.

Security
It is illegal to bring into the premises liquor, prohibited drugs, poisonous stuff, dangerous drugs, illegal firearms and also drugs and firearms banned by the Government and the International Law. It is also an offence to secretly consume these items within the premises and to arrive at the premises after consumption of these items. The Company pledges maximum security measures to prevent movement of any of the above to and fro from the premises and also to prevent such items being illegally shipped out.

Any employee who is found to have indulged in any of the above or being an accessory to the above will be handed over to the relevant authorities for whatever punishment to be meted out in accordance with the existing law.

Customs Regulations
At all times the Company will adhere to the Customs rules and regulations laid down by the Sri Lankan Government and will at all times refrain from breaking the law in importing or exporting raw materials, finished goods and when trading.

Welfare and Community Service

In addition to the wages, the Company will make maximum effort to improve the welfare of all employees. The Company will do its utmost to improve the community services in the surrounding environment and improve the living conditions of its employees.
